$24M Claim By NYSDOL
One of the leading transportation firms in its field was threatened by NYS Department of Labor with almost $12 million in fines for alleged over-time labor law violations. The client was advised by its former counsel, a specialized employment firm, to settle the matter for seven figures. Sullivan PC discovered several legal flaws in the proposed prosecution and believed that the client’s equitable position was strong. After the agency refused to discuss a reasonable settlement, we advised that the offer be withdrawn. After presenting its position to senior management at NYSDOL, the agency withdrew its claim.
